1. THE SERVICE; PRICE; PAYMENT; SCHEDULE; RISKS.

At Chi-Chi's, we pride ourselves on offering a diverse range of services tailored to meet the unique needs of your beloved pets. From exceptional pet boarding and engaging daycare to specialized grooming and professional training, we've got it all covered. Payments for our services are due in advance to ensure a seamless experience for both you and your pet. Please be aware that late payments may incur additional fees. It's important to note that Chi-Chi's reserves the right to decline services based on factors such as availability or the overall condition of your pet. Our commitment is to provide services that are not only exceptional but also considerate of your pet's unique requirements.

2. REPRESENTATIONS; RISKS.

At Chi-Chi's, we are genuinely passionate about the well-being of your pets. Before joining our extended pet-loving family, we kindly request confirmation that your pets are healthy, free from parasites, and up-to-date on vaccinations. This commitment helps us maintain a safe and nurturing environment for all our furry guests.

While we take every precaution to ensure the safety of your pets, it's essential to acknowledge the inherent risks associated with pet care services. Despite our vigilant efforts, unforeseen circumstances can arise, leading to potential injury or illness. To ensure the best possible care, we recommend bringing along your pet's vaccination records. Additionally, please be aware that our staff may not be continuously present in all areas at all times.

3. TERM; DURATION.

This Agreement comes into effect on the specified start date and remains in force until terminated. After the initial 30 days, either party has the option to terminate this Agreement with a 14-day notice, providing flexibility and convenience in our partnership. In cases where immediate termination is necessary due to safety concerns, Chi-Chi's reserves the right to suspend services if it reasonably concludes that your pet poses a danger to our personnel, other individuals, or animals.

Should the need for termination arise after notice, the non-breaching party will provide written notice of the failure. The breaching party will then have two business days to rectify the failure, with termination occurring if the issue remains unresolved.

4. EMERGENCIES.

At Chi-Chi's, we understand that emergencies can happen. In the event that your pet becomes unwell or poses a danger that prevents us from providing the agreed-upon services, we will make every effort to contact you or your designated emergency contact. If contact cannot be established, we seek authorization to arrange alternate care for your pet, including transportation to your specified veterinarian or an appropriate facility. You, as the client, agree to be responsible for all costs related to these actions, ensuring a prompt and effective response to your pet's needs.

5. MISCELLANEOUS.

At no point in our partnership shall Chi-Chi's be considered an employer of the client. To provide an additional layer of assurance, Chi-Chi's maintains a comprehensive general commercial liability policy, covering various aspects of our services. We understand that unforeseen circumstances, such as acts of nature, may cause delays or disruptions. In such cases, Chi-Chi's commits to making reasonable efforts to avoid non-performance and ensuring a swift return to normal operations.

This document serves as the complete and final understanding between both parties concerning the transaction outlined herein. It supersedes and replaces all prior and contemporaneous agreements and statements, whether written or oral. If any provision of this Agreement is deemed invalid or unenforceable, the provision will be enforced to the fullest extent possible under the circumstances, preserving the validity and enforce ability of the remaining document.

6. SPECIAL WAIVERS.

At Chi-Chi's, we cherish every pet, regardless of age or health condition. For dogs aged six years or older or those with pre-existing health conditions, the client acknowledges and waives any claim for injury, illness, or death experienced by the pet while in Chi-Chi's custody or thereafter. Similarly, if a client's dog is not spayed/neutered, the client agrees to defend, indemnify, and hold harmless Chi-Chi's, its members, managers, agents, and employees against all claims, demands, and causes of action arising from any action or proceeding connected with the client's dog.

7. AUTHORIZATION.

For added convenience, Chi-Chi's allows clients to authorize additional persons or an emergency contact to pick up their dogs. However, it is essential to keep the authorized list updated to avoid any complications. If an unauthorized person arrives to pick up the client's dog, Chi-Chi's will not release the pet and will continue to charge the client for boarding and associated costs until the authorized party arrives.

8. INDEMNIFICATION; RELEASE; LIMITATION OF LIABILITY.

To the fullest extent permitted by law, the client releases Chi-Chi's, its members, managers, agents, and employees (collectively the "Releases") from all claims of any nature related to or arising from the service, unless caused by the sole negligence of Chi-Chi's. This includes any claims for attorneys' fees and litigation expenses.

Without limiting the foregoing, the aggregate liability of the Releases to any person (including the client) related to the service and the client's pet shall not exceed the greater of the price of the service or the amount recoverable from Chi-Chi's insurance. The client further agrees to indemnify, defend, and hold the Releases harmless from any claims or assertions of any kind arising out of or related to the client's pet or the service. In no event shall the Releases be liable for consequential, special, exemplary, or punitive damages, even if advised of their possible existence.

 9. INJURIES AND MEDICAL CARE.
At Chi-Chi's, we are committed to the safety and well-being of your pet. In the unfortunate event that your dog sustains an injury while under our care, Chi-Chi's will take full responsibility for any necessary veterinary care, including covering the costs of medical attention. However, if your dog falls ill due to circumstances beyond our control, such as pre-existing conditions or exposure to external factors, Chi-Chi's cannot be held liable. In such cases, the responsibility for all medical care and associated expenses will remain with the pet owner.
